Copyhoit 

Frank Wilhoit's definition of conservatism is that "There must be in-groups whom the law protectes but does not bind, alongside out-groups whom the law binds but does not protect."

When applied to copyright and intellectual property rules, this means that more powerful actors can violate the rules with impunity but use them to prosecute less powerful ones and that less powerful actors must obey the rules but cannot use them to stop more powerful actors breaking them.

Because copyright and intellectual property rules usually have an exception for 'fair use' and the law is supposed to reflect what is fair, any powerful actor behaving this way is by definition legal and an example of fair use.

Copyhoit describes this general situation.

"Stealing content from a large language model to train another one is a copyhoit violation but stealing people's content to train a large language model and sell it back to them is just fair use."

"All my writing is under copyhoit so you can't just rip it off – but this publisher can."

"Copyhoit law is designed to promote innovation in expropriation and protect artists and other creators from the difficulties that come from owning their work"
