The instance of invoking postmortem advice for the benefit of someone that is objectively in the wrong, typically for how it makes the situation look rather than the morality of it. There is no real mercy involved with the invocation of Mercy for the Monster.
Usage is intended to show how deep the perpetrator has dug themselves in a given situation, provided from a pseudo-sympathetic standpoint, and is not an indication of support for the person or their action(s). Genuine support for the perpetrator is intended to defend their action(s) and are not Mercy for the Monster, as defending them is indicative of not viewing them as a monster in the given situation.

The judge asked the defendant what he was doing the night of the incident, and the defendant responded with, "I was washing my hands because my wife and I got into an argument, and I got upset, you know. I get violent when I'm upset, it happens. So I had to wash my hands after that."
The judge laughed in the man's face, laid down a harsh conviction, and employed Mercy for the Monster when he said, "You definitely shouldn't have said that. Now you're in for more charges than you started with!"

Clarence: I watched Fight Club with Nick yesterday and I think I've created a Frankenstein's Monster; now all he wants to do is fistfight people and pretend he's got split personality disorder.
