The libertarian abortion belief that the fetus is a human being. It also believes a fetus of a non-criminal unwanted pregnancy, and a fetus that was formed from a rape are trespassers who are equally innocent as a fetus that was consensually conceived. The fetus cannot be directly killed even by eviction. It also believes the mother has the legal property right to have the bodily autonomy and the proportionate ability to retaliate against the trespassing by evicting the fetus. It also believes in a legal proportionality for when an eviction can only be lethal and non-lethal. A non-lethal eviction must follow the non-aggression principle by the means of being gentle, non-aggressive, and non-criminal. A lethal eviction can only happen if the fetus is harming the life of the mother. When the mother has the proportional retaliatory right to evict the fetus in a harmful way she can’t kill the fetus. Both proportions must be carried out by the means of carrying the pregnancy until the undeveloped fetus is viable enough to be evicted and live independently outside of the womb.
