1099 employee

(noun; satirical, fictional legal jargon)

1099 Employee (ten-ninety-nine em-ploy-ee)

A legendary workforce classification occupying the narrow space between employee and independent contractor, in which an individual is expected to demonstrate the loyalty, availability, and productivity of a full-time employee while simultaneously enjoying the tax obligations, administrative burdens, and absence of benefits associated with independent self-employment.

Historical Note

Labor historians generally agree that the term emerged shortly after someone asked:

“How can we preserve all the advantages of having employees while simultaneously avoiding the costs associated with having employees?”

The answer, as with many management innovations, was to create a phrase that sounded official enough that nobody questioned it until tax season.

* Works exclusively for one organization while being repeatedly reminded of their entrepreneurial freedom.
* Receives detailed instructions regarding how work must be performed.
* Is encouraged to view lack of benefits as a valuable professional growth opportunity.
* Is described as an “independent business owner” immediately before being handed a mandatory schedule.
* Experiences the rare privilege of paying both halves of payroll taxes while exercising approximately half the independence advertised.
